The Clock Is Ticking—And So Is Your Portfolio
Bitcoin opened Tuesday at $63,463, flat from Monday. But don’t let the calm fool you. The market is holding its breath, and the next 72 hours could determine whether we see a breakout or a breakdown.
The CLARITY Act—formally the Digital Asset Market Clarity Act—would give the CFTC full oversight of digital commodity spot exchanges, brokers, and dealers, while keeping SEC control over tokenized securities. The House passed it back in July 2025 by a 294-134 margin. The Senate Banking Committee advanced it 15-9 in May.
So why isn’t it law yet?
Senate Democrats are demanding strict ethics provisions—including language that would bar public officials from selling digital currencies. Republicans are balking. And with a filibuster requiring 60 votes, the math just doesn’t work.
The War Inside Washington—And Inside Your Head
Former CFTC Chairman Chris Giancarlo—the man known as “Crypto Dad”—dropped a truth bomb on Sunday that should make every Bitcoin holder rethink their thesis.
“This is a change that is going to happen whether the CLARITY bill passes or not,” Giancarlo said. “It may change where it gets built and what gets built, but it’s not going to change whether this internet of value happens.”
His message? The industry has made a tactical mistake by publicly declaring it cannot move forward without the bill. Failure would simply “separate the builders from the bystanders”. “Fortune favors the bold,” he added.
That’s a radically different take from the panic you’re seeing on Crypto Twitter.
Bitwise CIO Matt Hougan agrees—sort of. He’s called CLARITY the “walking dead” if it misses this window. “Nothing can actually kill it, but it will lurch along”. He gives it roughly a 50-50 chance, but acknowledges failure before the recess has become “the more likely scenario”.
The SEC Wild Card Nobody’s Talking About
Here’s where it gets interesting—and where I think most retail investors are missing the real story.
If CLARITY fails, Hougan argues the SEC under Chair Paul Atkins is “ready, willing, and able to come out with rules that address the same issues”. And here’s the kicker: SEC rulemaking could actually be more innovation-friendly than a bipartisan bill.
The drawback? A future administration could install a less friendly SEC chair and reverse those rules. But Hougan believes crypto is approaching a point where its progress becomes “practically impossible to unwind”. “The genie’s out of the bottle,” he said.
Strategy CEO Phong Le made a similar point: rules are coming with or without Congress. He named SEC Chair Atkins, the CFTC, and Treasury Secretary Scott Bessent as three officials who already have rules “ready to go”.

The bear case: CLARITY fails, the market sells off, and we enter a prolonged period of regulatory uncertainty. Bernstein warns of a short-term selloff in Bitcoin and altcoins. Polymarket odds have already dropped 9 points in the past month. The Senate’s failure to act could push the bill into 2027. And let’s be honest—uncertainty is the enemy of institutional money.
The bull case: CLARITY failing isn’t the end—it’s a pivot. SEC rulemaking could be faster and more favorable than anything Congress would produce. The industry has $2.28 trillion in market cap backing it. BlackRock, Fidelity, Goldman Sachs—they’re all already in. As Giancarlo put it, failure just means “the premium for courage goes up”.
